DMCA Copyright Policy

Leawo Software ("we", "us", "the software" or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), Title 17, United States Code, Section 512, we will respond expeditiously to notices of alleged copyright infringement that are reported to our designated copyright agent.
1. Intended Use and Fair Use Disclaimer
Our software products, modules, and services are technical tools designed exclusively for legal, personal, and non-commercial multimedia processing.
- Personal Use Only: Our tools are intended for users to manage, format-shift, or back up their own legally acquired media files (such as physical discs or personal media libraries) for private, non-commercial enjoyment.
- Copyright Compliance: We do not condone, facilitate, or encourage the copyright infringement, unauthorized distribution, or commercial exploitation of any copyrighted materials.
- Fair Use Doctrine: We support the provisions of the Fair Use doctrine (17 U.S.C. § 107) for non-commercial personal archiving. Users are solely responsible for ensuring that their use of our software complies with local laws and the copyright terms governing their media.
2. Technical Tools and Non-Circumvention Compliance
Leawo software products are format-shifting, general-purpose multimedia management and conversion utilities.
- No DRM Circumvention Services: Our products are designed to assist users in managing, backing up, or transcoding media files that they have a lawful right to access. Our technology operates on standard recording, shifting, or standard processing mechanisms and is not intended to actively decrypt, bypass, or circumvent technological protection measures (TPMs) or Digital Rights Management (DRM) systems in violation of Section 1201 of the DMCA, except where such actions are legally permitted under established exceptions (e.g., for non-commercial personal backup and fair use archive of legally purchased media).
- User Independence: Our website does not host, store, or stream copyrighted audio, video, or torrent files. The software acts strictly as an offline client-side tool operated completely under the user's local hardware control.
3. Exclusion of Liability for Third-Party Content and Services
Our products may interact with third-party web services or physical hardware at the user's explicit direction.
- No Affiliation: Leawo Software is not affiliated with, endorsed by, or partnered with any online streaming platforms, music streaming services, or disc production studios. All product names, logos, and brands mentioned on our website are property of their respective owners.
- Third-Party Terms of Service: Users are strictly reminded that using tools to process content from third-party platforms must comply with those platforms' respective Terms of Service and local copyright laws. We do not accept responsibility or liability for any misuse of our software that breaches agreements between the user and third-party service providers.
4. Notice of Copyright Infringement (DMCA Takedown Notice)
If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our website by sending a detailed DMCA Notice to our Designated Copyright Agent.
To be valid, your DMCA Notice must be a written communication that includes substantially the following information:
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the specific URL).
- Your contact information, including your address, telephone number, and an email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

5. Counter-Notification Procedures
If you believe that your material was removed or disabled by mistake or misidentification, you may file a Counter-Notification with us. Upon receipt of a valid Counter-Notification, the DMCA provides that the removed material may be restored after 10 to 14 business days, unless the complaining copyright owner files a lawsuit seeking a court order against you.
Your Counter-Notification must be a written communication sent to our Designated Agent containing:
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, that you consent to the jurisdiction of the federal courts located in California), and that you will accept service of process from the person who provided the original DMCA notice.
- Your physical or electronic signature.
6. Repeat Infringers Policy
In accordance with the DMCA and other applicable laws, we maintain a policy of terminating or suspending, in appropriate circumstances and at our sole discretion, the accounts or access of users or affiliates who are deemed to be repeat infringers.
7. Modifications
We reserve the right to modify, alter, or update this DMCA Copyright Policy at any time. Any changes will be posted on this page with an updated effective date.
